This Non-Disclosure Agreement ("Agreement") is between the Photographer/Videographer and the Client(s) for wedding photography/videography services.

Purpose

The Client(s) agree to hire the Photographer for wedding photography/videography services on the Event Date. The Client(s) wish to keep the images and/or videos ("Media") private and request that the Photographer not use the Media for any public purposes.

Confidentiality Obligation

The Photographer agrees to keep all Media produced during the event confidential. This includes not displaying, sharing, or distributing the Media for portfolio use, social media, advertising, or any other public-facing purpose without explicit written consent from the Client(s).

Exclusions

The confidentiality obligations shall not apply to any Media that: • Was already public at the time of disclosure; • Becomes public through no fault of the Photographer; (for example shared by guests) • Is required to be disclosed by law or by a court.

Responsibility for Public Sharing

The Photographer is not responsible for any instances where the Media is shared publicly by the Client(s), their guests, or any other third party who may have access to the Media. The Client(s) acknowledge that once the Media is delivered, they are responsible for controlling its distribution and access.

Limitation of Liability

The Photographer will take all reasonable measures to ensure the privacy of the Media as per this Agreement. However, the Photographer shall not be held legally responsible for any instances where the Media is shared publicly or otherwise disclosed without the Photographer's consent due to actions by third parties, unforeseen circumstances, or actions by the Client(s).

Indemnification

The Client(s) agree to indemnify, defend, and hold harmless the Photographer from any and all claims, losses, damages, liabilities, and expenses (including reasonable attorney's fees) arising from the Client(s) or third-party actions that result in the public disclosure of the Media, in violation of the confidentiality terms of this Agreement.

Compensation

Additional Fee for NDA: £250 The Client(s) agree to pay the additional fee in exchange for privacy under this Agreement. This fee is due upon signing of the initial wedding agreement or as per the agreed payment schedule.
